These Terms of Use ("Terms") govern your use of hexiss.com and the assessment tools, reports, and content offered there (together, the "Service"). Hexiss ("we," "our," or "us") operates the Service. By using it, you agree to these Terms. If you do not agree, please do not use the Service.
The Service is designed for business owners and professionals. You must be at least 18 years old to use it. If you use the Service on behalf of a business, you confirm you have the authority to do so.
Hexiss is an educational self-assessment. You answer a set of questions about how your business operates. The Service then produces a report that includes a condition band, an area-by-area view of how the business is functioning, and a prioritized list of suggested next steps.
It is a screening and reflection tool. It is not an audit, an inspection, a valuation, or a review of your business by a professional. It works only from the answers you give.
Hexiss is not a financial advisor, business valuator, attorney, accountant, tax advisor, or broker. Nothing in the Service is financial, legal, accounting, tax, valuation, or investment advice, and using the Service does not create a professional relationship of any kind between you and Hexiss.
Your results are an indicator, not a valuation, a prediction, or a guarantee of any outcome, including a sale price, a transition, or business performance. Before you make a significant decision about your business, talk with qualified professionals who can look at your full situation. You are responsible for decisions you make and actions you take.
Results depend entirely on the answers you provide. If your answers are incomplete, mistaken, or optimistic, your results will reflect that. Two people describing the same business can get different results.
We keep improving the assessment. Questions, scoring, and reports may change over time, so results from different versions may not be directly comparable. A result describes how you answered on the day you took the assessment, not a permanent condition of your business.
Use the Service lawfully and for your own business or for clients you advise. You agree not to:
The Service, including the assessment framework, questions, scoring methodology, report design, written content, and the Hexiss name and marks, belongs to Hexiss and is protected by intellectual property law. We give you a limited, personal, non-transferable right to use the Service for its intended purpose.
Your report is yours. You may keep it, print it, and share it with your own advisors, partners, or team. You may not publish it in a way that presents it as a Hexiss product or endorsement, and you may not reproduce the assessment itself.
How we collect and handle information is described in our Privacy Policy, which is part of these Terms. In short, you can complete the assessment without an account, sharing your email is optional, and contributing your anonymous responses to improve the assessment is a separate, optional choice.
If you choose to contribute anonymous responses, you allow Hexiss to use them to evaluate and improve the assessment, including reliability testing, scoring, and research on how the assessment performs, as described in the Privacy Policy. Those responses are not linked to your name or email.
You may reach Hexiss through a professional advisor, such as an accountant, banker, broker, or insurance agent. Those advisors are independent from Hexiss. They are not our agents, and we do not control the advice they give you or endorse it. The Service may also link to third-party sites or tools. We are not responsible for their content or practices.
The Service is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that the results will suit your particular situation.
To the fullest extent the law allows, Hexiss and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost business value, or lost opportunity, arising from your use of the Service or from any decision made or action taken in reliance on your results.
Our total liability for any claim related to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars ($100). Some places do not allow certain limits, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
You agree to hold Hexiss harmless from claims, losses, and reasonable expenses that arise from your misuse of the Service or your violation of these Terms.
These Terms are governed by the laws of the State of South Dakota, without regard to its conflict-of-laws rules. If a dispute comes up, please contact us first at [email protected] so we can try to resolve it informally. If that does not work, disputes will be handled in the state or federal courts located in South Dakota, and you and Hexiss consent to those courts.
We may update these Terms from time to time. When we do, we will change the "Last Updated" date above. If a change materially affects your rights, we will make a reasonable effort to let subscribers know by email. Continuing to use the Service after changes are posted means you accept them.
We may change, suspend, or discontinue any part of the Service at any time, and we may restrict access for anyone who violates these Terms.
If any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a provision right away, that does not mean we have given it up. These Terms and the Privacy Policy are the entire agreement between you and Hexiss about the Service.
